Consultation Terms & Conditions
Thank you for your interest in booking a consultation with me. These terms relate to my consultation process, as well as your obligations pre- and post-consultation. They are designed to operate alongside my Website T&Cs and Privacy Policy, so please make sure that you have read all of my Terms before proceeding. They set out your important rights and obligations and I care about making sure that there are no misunderstandings. When you use my services, you agree that you are over the age of 18 and willing to be bound by these Terms of Service. If you are under 18, a parent or guardian will need to accept these Terms on your behalf. If you don’t accept these Terms, you should notify me before making your booking so I can discuss your concerns.
SERVICES AND DELIVERABLES
The services and deliverables referred to in these Terms include:
- Consultations, packages and programs
- Summary emails, e-books, guides, voice notes and handouts
- Scripts, referral letters or formal correspondence
- Product sales
If any services or deliverables outside the scope of the above are required, they will be quoted separately at my current hourly rate. I will discuss this with you if it becomes necessary, before any charges are incurred.
You agree to provide me with the relevant information I request from you, and any other information I reasonably require in order to perform the services. This may include information regarding any medical conditions or concerns, as well as updates following your initial consultation (as applicable). All information you provide will be dealt with in accordance with my Privacy Policy.
If you are communicating with me via electronic means such as email, I may not have full control over the transmission or storage of any personal information disclosed. You agree that by participating in such forms of communication you understand and accept that there is an inherent risk of disclosure or loss of your personal and sensitive information for which I cannot be held responsible. If you are concerned about transferring particularly sensitive information, please ask me about alternative options that may be more secure.
While I am committed to providing the highest standard of care and support, I cannot guarantee specific outcomes from my services. The results of any treatment depend on a wide range of factors, many of which are beyond my knowledge and control, including your unique circumstances, adherence to the recommended treatment plan, lifestyle factors, and underlying health conditions. I encourage you to engage fully in the process and communicate openly with me to optimise your outcomes, but please understand that achieving desired results is not guaranteed.
INFORMATION AND ADVICE
During our consultations, I may provide you with information that relates to your health, including providing you with a tailored plan aimed at improving your health and wellbeing. However, you acknowledge that this information is of a general nature only, and is not intended to constitute or replace professional advice for your specific situation.
I am not a medical professional and do not diagnose specific illnesses or disorders. My services are intended to support your overall wellbeing and are not a substitute for appropriately qualified medical diagnosis or treatment, particularly if you have a serious medical condition.
I only work with minors if there is a parent or guardian present. Your child may not need to attend the consultation if photos and relevant test results can be provided.
YOUR RESPONSIBILITIES
Your mindset matters. Progress often begins with the belief that improvement is possible. I don’t have a magic wand, but I’m here to guide and support you as you work toward better health. However, if you are convinced that your issue cannot change, my suggestions may not be as effective.
If you have a history of trauma or if any part of our work together triggers severe anxiety or distress, please notify me immediately. I encourage you to also seek support from mental health professionals who can provide the necessary care and assistance. If your concerns are urgent, don’t wait! Seek immediate advice from an appropriately qualified professional.
I am passionate about addressing the root cause of your concerns, which requires adequate consultation time, comprehensive test results, and a full declaration of any medications you are currently taking. This enables me to gather a complete case history and carefully consider all aspects of your condition before creating a personalised treatment plan. To support this process, please ensure you book a consultation length that realistically allows for a thorough discussion of your needs. For serious or complex issues, or pathology or functional test reviews, a shorter consultation will not provide sufficient time to address your concerns effectively.
You agree to completing any tasks that I have set in your treatment plan, or to exploring the obstacles and barriers creating resistance that are stopping you from doing so. It is helpful if you keep an open mind and be willing to see your treatment plan through without expecting to see instant changes, as our bodies don’t work this way. You are always entitled to refuse my suggestions if, after careful consideration, you decide they are not right for you.
For me to provide the best care, it’s vital that you communicate openly and honestly about your symptoms, challenges, and experiences. Failure to disclose relevant circumstances or considerations may limit my ability to assist you effectively, and in some cases may be dangerous to your health. You don’t have to provide information you don’t want to tell me, but I do ask that you explain that you are not comfortable discussing a particular topic, rather than giving an answer that is not true. You are responsible for providing me with any relevant test results. New results from DHM or Laverty labs can be uploaded securely to my practitioner portal by requesting your GP to copy me into the results and requesting the lab to do so at your blood draw. Functional tests will come directly through to my practitioner portal. You may also email through your results prior to your consultation/s for review.
If you are under the care of other healthcare professionals, it is important that you continue your treatment with them and keep them informed of the care I provide. I’m happy to collaborate with your medical team to support you holistically.
I use both my own dispensary and an external supplier for supplements. You are responsible for purchasing and taking these in accordance with your treatment plan. Any recommendations or suggestions I provide are for you alone, based on your specific needs. They must not be shared with others.
For online consultations, you will need a reliable computer, webcam, and internet access. If you are joining me for an online call, please ensure that you have a quiet, private place where you can speak freely and will not be disturbed during the consultation. Your safety is important to me. I will not conduct a consultation with you while you are driving. If you must be in your car, please ensure that you are parked in a safe place and make yourself as comfortable as possible.
ACKNOWLEDGEMENT AND WAIVER
I take my obligations under Australian Consumer Law seriously and will do my best to address any issues that arise. However, even if there is a major problem, my liability is strictly limited to:
- providing my services again; or
- if I am unable to do so within a reasonable time, refunding the full amount that you have paid to me.
If you feel that there is any problem with my services, please let me know within 24 hours. I am keen to understand what has gone wrong if you are unhappy so that I can address your concerns and try to find a mutually acceptable solution.
By proceeding with my services, you acknowledge that you:
- are medically fit to participate in any programs or treatments I recommend;
- accept full responsibility for your own health;
- have consulted a medical professional if you have knowledge of any pre-existing medical conditions, and will abide by their instructions as appropriate;
- will consult a medical professional promptly if you become aware of any medical conditions, whether pre-existing or obtained following provision of the services; and
- are solely responsible for implementing any strategies suggested as part of the services and will do so in a safe manner.
While I make all reasonable efforts to ensure that my services meet with the highest standards of best practice, if something does go wrong that is not a direct result of my negligence, misrepresentation or deliberate fault, you agree that, to the fullest extent permitted by law, I will not be liable for any loss or damage arising out of or related to my services, irrespective of whether such damages were foreseeable, and regardless of the nature of the claim.
You take full responsibility for your implementation of any suggestions that I may make while providing my services. You understand that my advice is limited to providing you with options for your consideration, and that you are solely responsible for any actions that you choose to take. Always consult your own values and vision, do your own research, and check with appropriately qualified professionals before making major decisions or significant changes. You agree to indemnify me against all consequences arising directly or indirectly from your choices.
You expressly agree that if this indemnity is unenforceable for any reason, my total cumulative liability for all causes of action of any kind (other than negligence or deliberate wrongdoing) shall not exceed the amount that you have paid to me in the 6 months before the cause of action arose.
FEES AND PAYMENTS
All prices are in Australian Dollars (AUD) and are inclusive of any Australian Goods and Services Tax (GST) (as applicable). Service and product prices may change at any time without advance notice to you. Purchases will be charged at the price in force at the time your order is validated.
I reserve the right at any time to modify or discontinue the product or service without notice at any time. I shall not be liable to you, or to a third party, for any modification, price change, suspension or discontinuance of a previously advertised product or service.
I offer the option to pay for my products and/or services by credit card, PayPal or direct deposit. Program, package and individual consultation fees are payable in full at least 24 hours prior to your first consultation, or prior to each individual consultation for single sessions, unless I have agreed to other arrangements in advance. You acknowledge and agree to make timely and full payments to me for the products and/or services purchased. Where you use a credit card, you warrant that you have the necessary rights and authority to use that credit card.
Payments are processed using Stripe. I do not have access to your account details. Any financial information you enter is stored under Stripe’s security policy: https://stripe.com/docs/security/stripe.
All prices are in Australian dollars. Naturopathic consultations and testing are exempt from GST. All product purchases, administrative fees and charges are inclusive of GST.
Where you fail to make payment or payment is declined for any reason, I may revoke your access to my products or services.
You agree to pay any costs I reasonably incur in chasing overdue payments, including administrative fees, debt recovery fees and legal fees.
CONSULTATION PACKAGES & PROGRAMS
If you have chosen a package or program including 1:1 consultations, all consultations must be used within 6 months of the package or program start date. Unused consultations will expire without refund. If unexpected circumstances beyond your control are preventing you from using your remaining sessions, please reach out so I can discuss the best way forward.
Where added benefits are offered within a package or program, including, but not limited to, product discounts and additional contact hours, these bonuses will cease within 2 weeks from your final consultation.
There is no refund for change of mind on consultation packages or programs, as you receive access to a range of benefits that are not available for single consultations. Please ask questions and ensure that the package or program you are considering is the best choice for you before committing to your purchase.
Payment plans on consultation packages and programs are offered for your convenience only, so you can spread your payment out over time. You are still committed to paying the whole amount, even if you change your mind about working with me. This is because you are asking me to hold you accountable and help you to stick to the plan, even if you feel like quitting, and I have held space for you in my booking calendar and turned away other clients so I could commit to supporting you. Allowing you not to complete your payment plan obligations would also be unfair discrimination against clients who have paid in full upfront. It is your responsibility to ensure you have sufficient funds to make payment instalments on time, and to contact me immediately if there are any problems.
CANCELLATIONS & REFUNDS
I offer a full refund or credit if you wish to cancel your appointment booking due to change of mind, so long as you notify me at least 24 hours before your consult time.
If you need to cancel or reschedule, please notify me via email at info@katepowe.com at least 24 hours prior to your consultation. Appointments cancelled or rescheduled with less than 24 hours’ notice will incur an administrative fee of $33.
I ask that you respect our scheduled time together. If you have not arrived, I will send you an email 5 minutes after the start time. Please be aware that if you arrive late, we still need to finish at the scheduled time. If you have not arrived 15 minutes after the consultation was due to start, you will forfeit your booking and there will be no refund. After 2 no-shows, no further bookings will be accepted.
If you are prevented from attending your consultation due to an emergency beyond your control, please contact me as soon as possible to let me know. I may agree to reschedule at my sole discretion.
If I have to cancel a consultation for any reason, I will give you as much notice as possible and reschedule at a time to suit us both.

Please ask questions and ensure that the package or program you are considering is the best choice for you before committing to your purchase.
INTELLECTUAL PROPERTY
I retain ownership of all intellectual property rights (including moral rights) in the materials I may use or provide to you in the course of delivering the services. These materials are provided to you under a single-use licence for your individual purposes, and are not to be used for commercial services or shared with others.
CREDIT FOR SERVICES
I retain the right to reference the services I have provided to you (including your name and any photos you may provide) on my website, social media and any other media for recognition or professional advancement purposes. I will anonymise any case studies, feedback or testimonials, and not disclose any sensitive or personal information.
Wherever applicable, you agree to credit me with provision of the services wherever reference to them may appear.
DISPUTE RESOLUTION & JURISDICTION
If a dispute arises, you agree that you will not engage in any public discussion about the issues, will behave politely towards me, and will avoid any conduct or communication which might reasonably be expected to interfere with my business or personal interests. You agree to act in good faith and be reasonably cooperative at all stages of the dispute resolution process. I will treat you with the same consideration.
If you have any concerns or complaints, you agree to communicate with me with the intention of making a genuine effort to seek a win/win solution and trying to resolve the dispute in good faith through negotiation and discussion. Please email me at info@katepowe.com and expect a response within 2 business days.
If the problem cannot be resolved within a reasonable time, you agree to engage in mediation and alternative methods of dispute resolution, with litigation being a last resort. I commit to making a similar effort to resolve any disputes in a friendly manner.
This agreement is subject to the governing law of New South Wales, Australia. Regardless of where you live in the world, you irrevocably agree that if the dispute resolution processes fail, the courts of New South Wales, and the Commonwealth of Australia, will have exclusive jurisdiction.
A lot of effort has been invested in making this agreement easy to read and fair to everyone involved. Please let me know if you find anything that is not fully aligned with my practice, or which is difficult to understand. Copying this document without permission is a breach of copyright.
